Terms & Conditions

These Terms and Conditions apply to all purchases of Dalray products, including online purchases, trade orders, email orders and wholesale accounts. By purchasing or using Dalray products, you agree to the following terms.

1. Product Use and Suitability

Dalray limewash and mineral paint products must be used in accordance with the instructions provided. It is the responsibility of the buyer to determine whether the product is suitable for their intended surface and application. Dalray does not guarantee the suitability of the product for any specific purpose or application unless stated in writing.

2. Surface Preparation and Application Responsibility

Surface condition, preparation and application technique are outside of Dalray’s control. The buyer is responsible for ensuring the surface is sound, clean, properly prepared and compatible with mineral coatings. Poor surface preparation, contamination, incompatible primers/sealers, moisture issues and incorrect application can affect the finish and performance. Dalray accepts no responsibility for failures caused by improper use.

3. Natural Variation

Dalray limewash is a natural mineral coating. Variations in colour, absorbency, texture, patina and final appearance are an inherent feature of the product and are not considered faults or defects. Coverage rates may vary depending on surface porosity and application method. A test area must be completed prior to full application to confirm suitability.

4. No Guarantee of Results

Application results depend on surface condition, environment, user technique, dilution and preparation. Dalray makes no guarantee regarding final appearance, performance or durability, as these factors are outside of our control. By using this product, you acknowledge that final results are the responsibility of the user.

5. Safety and Handling

Dalray products are supplied in powdered form and contain lime, which is alkaline. Safe handling is required. Avoid inhalation of dust and contact with eyes or skin. Use appropriate personal protective equipment (PPE) including gloves, safety glasses and a mask, and ensure adequate ventilation during mixing and application. Keep out of reach of children and pets.

6. Advice and Guidance Disclaimer

Any guidance or recommendations provided by Dalray, whether in written, verbal or digital form (including by email, social media, website content or messages), is general in nature. Such information does not constitute professional advice. The buyer is responsible for making independent assessments and conducting test patches before use.

7. Limitation of Liability

To the extent permitted by law, Dalray’s liability is limited to the replacement of the product or a refund of the purchase price. Dalray is not liable for labour costs, application costs, loss of time, indirect loss, consequential loss, surface failure, damage to property or claims arising from incorrect use, surface conditions or failure to follow instructions.

8. Australian Consumer Law

Nothing in these Terms and Conditions excludes or modifies any rights you may have under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. However, to the extent permitted, our liability is limited as stated above.

9. Order Acceptance and Availability

All orders are subject to acceptance and availability. Dalray reserves the right to refuse or cancel orders at its discretion, including in cases of suspected misuse or commercial conflict.

10. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.

Warranty

Dalray warrants that its products are free from defects in materials and manufacture at the time of purchase. Because limewash is a natural mineral coating, its performance and appearance depend entirely on factors outside our control — including substrate condition, preparation, dilution, environmental conditions, surface porosity, and application technique. For this reason, Dalray does not warrant the applied finish, durability, coverage, or colour outcome.

This warranty applies only when the product is used strictly in accordance with Dalray’s instructions, technical data sheets, and safety guidelines, and only when applied to suitable substrates.

This warranty does not apply to issues arising from:

• improper or insufficient surface preparation
  
• use over sealed, coated, contaminated, or unsuitable substrates
  
• incorrect dilution, mixing, application tools, or technique
  
• environmental or site conditions during application (humidity, temperature, sunlight, moisture, etc.)
  
• natural variation, patina development, or chalkiness characteristic of mineral finishes
  
• wear, abrasion, cleaning, or maintenance practices
  
• changes made after mixing (including additives or tinting not supplied by Dalray)
  

Dalray’s responsibility is limited exclusively to replacement of the product or a refund of the purchase price if a manufacturing fault is confirmed.

Dalray is not liable for labour costs, application costs, consequential loss, or any claim relating to the applied finish.
